New changes in the law “On Banks and Banking Activities” in connection with the introduction of the digital ruble: what participants need to know
A draft law “On Amending Article 115-FZ and Article 20 of the Federal Law ‘On Banks and Banking Activities’ in Connection with the Introduction of the Digital Ruble” is being prepared for adoption in the second reading.
The current legal framework for the operation of the platform does not provide for the fulfillment of requirements to prevent illegal financial activities in transactions with digital rubles. If adopted, the draft law “On Amendments to Federal Law 115-FZ and Article 20 of the Federal Law ‘On Banks and Banking Activities’ introduces significant changes in the scenarios of work with the digital ruble. The draft law provides for a multi-level model for the enforcement of requirements to prevent illegal financial transactions, which also includes the involvement of both credit organizations – participants of the platform, and directly the operator of the CD Platform (the Bank of Russia).
This functionality will be divided between Financial Intermediaries and the Digital Ruble Platform operator. For example, it is planned that Financial Intermediaries, which are banks, will send the following messages to the CD Platform:
– notification of the presence of the CD Platform client on the Rosfinmonitoring list;
– notification of refusal to make a payment on the CD Platform;
– notification that the payment cannot be made on the CDP Platform.
AML/CFT procedures are expected to be carried out for account opening, replenishment of SDCs, conclusion of SIS, C2C, C2B, B2B, C2G, B2G transactions. It is envisaged to conduct post-control of operations on the CD Platform: C2C, C2B, B2B, C2G, B2G, B2C, G2C, G2B, write-off of digital rubles on the operator’s initiative, execution of SIS, exchange of non-cash money for digital rubles and digital rubles for non-cash.
If the draft law is passed and approved, the participants of the CD Platform will have to support the changes in a productive environment from 01.07.2025.
Due to the upcoming changes in legislation, Digital Ruble Platform participants will need to adapt to the new environment. Within the framework of the CD project, Right line has already connected 10 banks to the platform. The expertise accumulated during the project allows Right line to promptly respond to all changes occurring in the CD Platform and to modernize its solution “PCR-Connect” in a short period of time taking into account all new requirements.
